Terms and Conditions (AGB) – Fruitally

1. Scope

These terms and conditions (T&Cs) apply to all purchases of dried fruits made via the online shop of Fruitally, based in Armavir, Armenia Fruitally by consumers worldwide.

2. Contract Conclusion

  • The presentation of products in our shop is not a binding offer, but an invitation to place an order.

  • By submitting an order, you make a binding offer to purchase.

  • The contract is concluded when we confirm the order by email.

3. Prices and Payment

  • All prices are listed in EUR and include VAT if applicable, plus shipping costs.

  • Accepted payment methods include credit card, PayPal, bank transfer, or other methods offered in the shop.

  • Payment is due immediately upon order confirmation.

4. Delivery and Shipping

  • We ship worldwide unless prohibited by law or logistical restrictions.

  • Delivery times vary by destination and are displayed during checkout.

  • We will notify you promptly of any delivery delays.

5. Right of Withdrawal

  • You have the right to withdraw from this contract within 14 days without giving any reason.

  • The withdrawal period is 14 days from the day you or a third party (other than the carrier) received the goods.

  • To exercise the right of withdrawal, you must inform us via a clear statement (e.g., by email).

  • You bear the direct cost of returning the goods if they match what you ordered.

6. Retention of Title

  • Goods remain our property until full payment is received.

7. Warranty and Liability

  • Statutory warranty rights apply.

  • We are liable only for damages resulting from intentional or grossly negligent conduct.

  • For damages due to simple negligence, we are only liable for breaches of essential contractual obligations and limited to foreseeable damages.

8. Data Protection

  • We collect, process, and use your personal data solely in accordance with applicable data protection laws.

9. Governing Law and Jurisdiction

  • The laws of the Republic of Armenia apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

  • The exclusive place of jurisdiction for disputes arising from the contract is Armavir, Armenia, to the extent permitted by law.

10. Final Provisions

  • Should any provision of these T&Cs be wholly or partially invalid, the validity of the remaining provisions remains unaffected.

  • Amendments or additions to these T&Cs must be made in writing.
